STF Orders Urgent Review of Roraima Election Deadlines Today

The Supreme Federal Court (STF) has determined that the Regional Electoral Court of Roraima (TRE-RR) review the deadlines established for the supplementary elections for governor and vice-governor of the state. The decision, signed by Minister Flávio Dino, orders the TRE to reexamine specifically the deadlines for disqualification, which had been set at 24 hours for candidates who wish to run for office. This measure was necessary after the then-governor Edilson Damião had his mandate revoked by the Superior Electoral Court (TSE) and former governor Antonio Denarium was declared ineligible, both for abuse of political and economic power.

The revocation of the mandate of governor Edilson Damião and the ineligibility of Antonio Denarium created a vacancy in the government of Roraima, making it necessary to hold supplementary elections. In these cases, disqualification is an essential requirement for candidates to be able to run for office, ensuring the integrity of the electoral process. The TRE-RR had established a 24-hour deadline for this disqualification, which was questioned by the Republicanos party. The STF’s decision now allows the TRE to reexamine these deadlines in light of electoral legislation, specifically Complementary Law No. 64/90, which establishes disqualification periods of 6, 4, or 3 months.

The STF’s determination aims to ensure that the electoral process in Roraima is conducted in a manner compatible with the Constitution and electoral legislation. Minister Flávio Dino emphasized that deadlines must follow what is established by law and that the TRE cannot create new deadlines, as this is an exclusive competence of the National Congress. With this decision, the TRE-RR will have to reevaluate the deadlines to ensure that the supplementary elections are held in a fair and transparent manner.
